Terms & Conditions of Service

Made In Motion provides:

• Creative tools to design, remix, and customize concepts and visual assets.
• A publishing and sharing platform for Your Creations.
• Optional commerce functionality enabling You or others to purchase Products incorporating Your Creations, produced by Third-Party Partners.

Made In Motion:

• Does not manufacture Products.
• Does not guarantee that a Product will identically match a digital preview.
• Does not act as Your employer, agent, or fulfillment provider.

We facilitate the process, but Third-Party Partners are responsible for production, shipping, and delivery.

In order to use the service, you must:

• Be at least 18 years old.
• Provide accurate information when creating an account.
• Keep your login credentials secure.

You are responsible for all activity under your account.

We may suspend or terminate an account at our discretion if you violate these Terms.

You retain ownership of Your Content. By uploading or creating Content, you grant Made In Motion a non-exclusive, worldwide, royalty-free license to use, display, modify, reproduce, and distribute Your Content solely to operate and improve the Service.

You agree that Your Content will not:

• Exploit or endanger minors
• Promote hate, violence, harassment, or illegal behavior
• Violate intellectual property rights
• Include personal or confidential information of others without consent
• Promote self-harm or terrorism
• Spread harmful misinformation

We may remove any Content or suspend accounts that violate these rules.

You represent and warrant that:

• You own or have rights to all Content you upload
• Your Content does not infringe any third-party rights

Purchases made through the Service are processed via Apple, Google, Stripe, or other authorized payment providers.

You agree that:

• Prices may vary by location and are subject to change
• Taxes, shipping costs, and fees may apply
• All purchases are subject to the terms of the relevant payment processor

Made In Motion does not store or process payment card information.

All Products are manufactured and fulfilled by independent Third-Party Partners.

Therefore:

• Made In Motion does not guarantee production or shipping timelines
• Product quality is the responsibility of the Third-Party Partner
• Colors, materials, and print results may vary from digital representations

If you experience an issue with a purchased Product, contact us at support@madeinmotionapp.com within 30 days, and we will coordinate with the partner to resolve it. Remedies may include replacement or refund, depending on partner policies.

Made In Motion is not liable for:

• Delays caused by carriers
• User-provided incorrect shipping information
• Creative or design errors made by the user
• Damage occurring after delivery

Made In Motion's trademarks, branding, UI/UX assets, and software are protected and may not be copied, modified, or used without permission.

Digital mockups, templates, UI elements, or design tools offered in the Service may be used only within the Service and for creating Products or Creations.

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent, abusive, or harmful behavior
• We believe your actions create legal or security risk

You may terminate your account at any time through in-app settings.

To the fullest extent permitted by law:

Made In Motion is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data, or reputation.

Made In Motion's total liability will not exceed:

The amount you paid to Made In Motion in the 12 months preceding the event, or $100 — whichever is greater.

The Service is provided "as is" and without warranties of any kind.

You agree to indemnify and hold harmless Made In Motion PBC from claims arising from:

• Your Content
• Your violation of these Terms
• Your misuse of the Service

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.

You agree to:

• Contact us first to resolve disputes informally
• If unresolved, disputes will be handled through binding arbitration in Delaware under AAA rules
• Claims must be brought individually — no class actions
